Application Terms and Conditions of Use and Privacy Policy

1. Responsible for the App
The Beat It application is developed and maintained by Roman Koch (developer), who is solely responsible for the management and operation of the app. For any inquiries, users can reach out via email at apps@romankoch.online.

2. Object
The Beat It app has been developed to provide users with a fast and user-friendly tool for logging blood pressure and heart rate. It includes features such as logging blood pressure and heart rate, exporting readings as PDF or other formats, charts and trends view, and optional synchronization of readings to Apple Health.

3. Compatible Devices
The Beat It app is currently available exclusively on the Apple App Store for iOS devices. Users must comply with all applicable terms and conditions set by the Apple App Store for downloading, installing, and updating the app.

4. Start
Beat It offers two ways to unlock the full version of the app:
- Monthly Subscription - an auto-renewing subscription that unlocks all premium features for as long as it remains active. Users subscribing for the first time receive a free trial period (currently 7 days) so they can test the app at no cost. The trial duration may vary based on promotions or future changes to the app.
- Lifetime Version - a one-time purchase that unlocks full access to all features permanently, with no recurring payment.
If the free trial is not cancelled at least 24 hours before it ends, it automatically converts into a paid monthly subscription, and the subscription renews each month until cancelled. Payment is charged to the user's Apple Account at confirmation of purchase and upon each renewal. Subscriptions can be managed or cancelled at any time in the App Store account settings; any unused portion of a free trial is forfeited when a subscription is purchased.

Until the app is unlocked through either option, features remain locked.
All purchases are made via the Apple App Store using the available payment methods.
All user preferences and configurations can be managed anytime through the in-app settings.

5. Intellectual and Industrial Property Rights
All intellectual and industrial property rights related to the Beat It app are the exclusive property of the developer, Roman Koch, who retains full rights over the exploitation of the app in all its forms, including reproduction, distribution, public communication, and modification.
Any third-party elements used within the app - such as icons, illustrations, or libraries - have been included under the appropriate licenses and authorizations.

The user acknowledges that the following actions are strictly prohibited and constitute a violation of intellectual property rights:
- Copying, altering, distributing, selling, decompiling, or disassembling the app
- Using reverse engineering or other techniques to extract or reconstruct the source code
- Republishing or reusing any components of the app without permission
Users agree to refrain from any actions that could infringe upon the developer's intellectual property rights or violate the integrity of the app.

6. Privacy Policy
6.1 General Principle
The Beat It app does not collect, store online, or process any personal data. All information is stored locally on the user's device. No data is transmitted to any external server or shared with third parties.
As such, users can enjoy the full functionality of the app without needing to create an account or share personal information. The app operates entirely offline and ensures full privacy.

6.2 Health Data and Apple Health (HealthKit)
Beat It uses Apple's HealthKit framework so that the readings you enter in the app can optionally be saved to the Apple Health app on your device.

What data is involved
Beat It may write the following data to Apple Health:
- Blood pressure readings (systolic and diastolic values)
- Heart rate readings
- The date and time associated with each reading
Beat It writes this data to Apple Health only. The app does not read, import, or query any health data from Apple Health.

How the data is used
Health data is used exclusively to provide the core functionality of the app: recording, displaying, charting, and exporting your own blood pressure and heart rate readings, and - with your permission - storing those readings in Apple Health so they are available to you across the Health ecosystem.

What we never do with your health data
- Health data obtained through or written to HealthKit is never transmitted to the developer, to any server, or to any third party.
- Health data is never used for advertising, marketing, or any similar service.
- Health data is never used for data mining, profiling, analytics, or any purpose other than health, fitness, and medical research (and Beat It does not conduct research).
- Health data is never sold, rented, licensed, or disclosed to data brokers, insurers, employers, or advertising platforms.
- The app does not require an account, and health data is never linked to an online identity.

Your control over health data
- Access to Apple Health is optional. The app asks for your explicit permission before writing any data, and Beat It remains fully usable if you decline.
- You can grant or revoke Beat It's HealthKit permissions at any time in the iOS Settings > Privacy & Security > Health > Beat It, or in the Health app > Sharing > Apps.
- Data that Beat It has written to Apple Health remains under your control in the Health app and can be reviewed or deleted there at any time.
- Readings stored inside Beat It can be deleted individually within the app, and all app data is permanently removed from your device when you delete the app.

Data storage and security
All readings entered in Beat It are stored locally on your device. Data written to Apple Health is stored in Apple's encrypted HealthKit store on your device and is protected by your device passcode, Face ID, or Touch ID, and by any iCloud protections you have enabled. The developer has no access to this data at any time.

Medical disclaimer
Beat It is a logging and visualization tool, not a medical device. It does not provide diagnosis, treatment, or medical advice. Always consult a qualified healthcare professional regarding your blood pressure, heart rate, or any other health concern.

6.3 Children
Beat It is not directed at children under the age of 13 (or the equivalent minimum age in the user's jurisdiction), and the developer does not knowingly collect any data from them. As the app collects no data at all, no such data can be stored or transmitted.

6.4 Changes to this Privacy Policy
This Privacy Policy may be updated to reflect changes in the app's functionality or in applicable law. The current version is always available at the Privacy Policy URL listed on the app's App Store page, together with the date of the last update.

7. Responsibility
Beat It strives to deliver the best possible experience with a focus on stability, accuracy, and usability. However, the developer assumes no liability for issues outside their reasonable control, including disruptions, errors, or damages caused by technical failures or third-party actions.

7.1 Service Interruptions and Technical Issues
Beat It is not liable for damages resulting from:
- Interruptions, errors, or malfunctions due to unexpected technical problems, maintenance work, or software updates
- Connectivity issues related to network problems, device incompatibility, or Apple App Store service outages
- Temporary unavailability of the app caused by system vulnerabilities or cybersecurity incidents

Users are encouraged to maintain updated device security measures, including antivirus software and regular OS updates, to reduce risks while using the app.

7.2 Third-Party Actions and Misuse of the App
Beat It disclaims responsibility for:
- Unauthorized access or misuse by third parties (e.g., hacking attempts or tampering)
- Any damage caused by improper or unintended use of the app that violates the Terms of Use or general guidelines
Users are expected to use the app in a lawful and respectful manner, in line with its intended purpose.

7.3 Force Majeure and External Factors
The developer is not responsible for interruptions or limited access to the app caused by events beyond their control, including but not limited to:
- Natural disasters (e.g., earthquakes, floods)
- Government regulations or legal restrictions
- Labor strikes, internet outages, or other force majeure circumstances

8. Nullity and Ineffectiveness of the Clauses
If any clause within these Terms and Conditions is declared wholly or partially invalid or unenforceable, such declaration shall only affect the specific clause in question. The remaining terms will continue to be valid and enforceable to the fullest extent permitted by law.

9. Applicable Law and Jurisdiction
For all legal matters relating to the use of the Beat It app:
- For Individual Users: The applicable laws and jurisdiction shall correspond to the user's country of residence.
- For Professional Users or Legal Entities: The laws of the Federal Republic of Germany shall apply, and the courts of Germany shall have jurisdiction.
